A 71-year-old woman from Richland Hills, Texas, has been arrested and charged for a hate crime for assaulting a 25-year-old man with her wooden cane because she believed he is gay and has AIDS, the Star-Telegram reported.
Richland Hills is in North Central Texas and about 37 miles west of Dallas.
Police say Wanda Derby beat Lloyd Guerrero, her neighbor and her son's roommate, with her cane and choked him because she believes he is gay.
"As I lifted up my arm, when I saw her, she just hit me right here," Guerrero told the Houston news station KHOU. "She was hitting and screaming and hitting and screaming and hitting and screaming," he added.
Derby found out that her son was planning to move in with Guerrero and police say that's what ignited Derby's rage.
Guerrero, who is an aspiring actor, claims that Derby had been posting derogatory comments about him and his family last month on her Facebook page. She even wrote about Guerrero's sexual orientation and outed him.
"This is completely private," he said. "It's not anything I would ever in a million years post randomly. I'm the same as everyone else."
Derby also allegedly attacked Guerrero's mother who was inside his apartment at the time of the incident. The authorities say that Guerrero has bruises on his throat and body, which is enough proof that Derby attacked him.
The police also say that Derby used a homophobic epithet to describe the victim to investigators.
"This is a hate crime due to the statements the arrested person, Mrs. Derby, made to the officers on the scene," Richland Hills Detective Tye Bell said.
Derby has been charged with assault and aggravated assault with a deadly weapon enhanced as a hate crime.
"The charges are serious," Bell said. "First-degree felony is as high as you can go."
Guerrero believes she attacked him out of hate and agrees with the charges.
"I don't want anybody to do that and get away with it," Guerrero said.
